DQ Files & 49 CFR Part 391 Compliance

A Driver Qualification (DQ) file is the §391.51 packet every motor carrier must keep on every commercial driver. It contains the employment application, road test, MVR review, drug & alcohol consent, prior-employer verification, annual review, and driver-certification of violations.

FMCSA new-entrant and compliance-review audits start with the DQ file. A missing §391.21 application, a stale §391.25 annual review, or a gap in the §391.23 prior-employer investigation drives most §391-related violations cited in audit reports.

The compliance cluster below covers what each §391 subsection requires, when to refresh each document, which states impose extras (medical-card upload, intrastate variances), and how to convert the paper packet into an audit-ready digital DQ file.

Companion artifacts: a $25 fillable DQ File template at checkout that mirrors §391.51 line-for-line, plus reusable consent forms that satisfy DPPA + FCRA disclosure requirements without separate paperwork per state.

For carriers running at scale, the §391.27 List of Violations and §382.701 clearinghouse pre-employment query are the two documents that tend to drift first — both have hard annual cadences and both are commonly cited in failed audits.
